§ 1 Scope

These General Terms and Conditions apply to all transport, removal and related services provided by RG Transporte Niederrhein (Raul Gabriel Jurcut), hereinafter referred to as the "Contractor", to private and business customers, hereinafter referred to as the "Client".

Deviating terms of the Client are only recognised if the Contractor expressly agrees to them in writing.

§ 2 Scope of services

The Contractor provides in particular the following services:

  • Residential and commercial moves
  • Furniture transport
  • Transport in Germany, the Netherlands and Belgium
  • Disassembly and assembly of furniture, where agreed

The specific scope of services is defined in the individual quote or order confirmation.

§ 3 Quotes and conclusion of contract

Quotes from the Contractor are non-binding unless expressly marked as binding. A contract is only concluded upon written or electronic order confirmation or upon commencement of the service.

The Client is obliged to provide all information required for planning and execution (addresses, access routes, scope of goods to be transported, special requirements) completely and truthfully.

§ 4 Prices and payment

The prices stated in the quote apply. Unless otherwise agreed, prices are gross prices in euros including statutory VAT.

Additional services not included in the quote (e.g. waiting times, additional floors without a lift, special transports) are charged separately after prior agreement.

Payment is due within 14 days of invoicing unless otherwise agreed. In the event of late payment, the Contractor is entitled to charge statutory default interest.

§ 5 Client's obligations to cooperate

The Client shall ensure that:

  • goods to be transported are properly packed and suitable for transport
  • access routes are clear and safe to use
  • required permits (e.g. no-parking zones) are obtained in good time
  • valuables, cash and important documents are transported by the Client

§ 6 Dates and execution

Agreed dates are binding provided the Client fulfils their obligations to cooperate. In cases of force majeure, weather conditions or official orders, the date may be postponed; the Contractor will inform the Client without delay.

§ 7 Liability and insurance

The Contractor is liable for damage to goods being transported in accordance with statutory provisions, in particular the provisions of the German Commercial Code (HGB) on carriage contracts, where applicable.

Liability is excluded for goods that are not properly packed or are particularly sensitive, provided the Contractor has previously pointed out the risk.

Damage must be reported immediately, at the latest within 7 days of delivery, in writing.

§ 8 Cancellation and withdrawal

Cancellations must be submitted in writing. If cancellation is made less than 48 hours before the agreed date, the Contractor may charge a reasonable cancellation fee.

§ 9 Data protection

Personal data is processed in accordance with our privacy policy, available at transporte-niederrhein.de/en/datenschutz.

§ 10 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants is, where permitted, Goch.

Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
